A Malawian High Court Judge will make a ruling on November 20 as to whether the High Court should hear the group legal challenge of Madonna's recent adoption of a one-year-old boy.
David Banda now lives in the UK with the pop diva, where he can stay for up to 18 months. The Malawian Human Rights Consultative Committee (MHRCC) - a group consisting of 67 NGOs - initiated the legal action against Madonna. A spokesman for Eye Of The Child, one of the groups in the MHRCC, said in October, "[The government] haven't followed the law. What has happened is a shortcut."Justin Dzonzi, the lawyer representing the MHRCC, said, "All the parties have been heard and the court has reserved its ruling because the Malawi Human Rights Commission also applied to be part of the case and the judge wants more time before he can make an order."
Whilst the child's father, Yohane Banda, does not support the legal action, he admitted confusion surrounding the terms of the adoption. He was under the impression that Madonna would one day return his son to his homeland. If the adoption is declared fully legal, the boy would remain with Madonna for an indefinite period.
