Lindsay Lohan will be able to leave the slammer if she posts $US300,000 bail after an earlier ruling was overturned saying she had to spend at least 30 days behind bars.
L.A. County Superior Court Judge Patricia M. Schnegg overturned the earlier ruling just hours after Lohan was sentenced the first time after failing a court-ordered drug test.
The original sentence came from Judge Elden Fox, who sent the actress to prison pending an October 22 hearing, which would decide whether she would be incarcerated for drug use.
Shawn Chapman Holley, Lohan’s lawyer said in a statement, “The case law is clear, she is entitled to bail.”
Lohan has been sentenced to prison before, but was released early due to overcrowding in the women’s prison system.
