Foo Fighters are suing an Australian advertising agency after discovering one of their songs was used without permission in an advertisement from a message of their website forum.
The Age reports that Brisbane firm Re-Max advertising used a potion of the Foo Fighters song 'Learn To Fly' in a television ad.Foo Fighters learned about the infringement on their copyright when a fan asked the question ''Over here on Australian television we have a company called Re-Max [sic] advertising, they are using the riff from Learn to Fly and I was wondering whether Foo Fighters were aware of it at all?"
That has now started legal action that will now be heard in the Australian Federal Court.
The piece used in the actual advertisement is not Foo Fighters but something recorded by a contactor to the agency.
Foo Fighters claim that the piece contains "a substantial part" of their work.
