A judge has rejected a lawsuit by Carly Simon against Starbucks for her last album failing to sell.
In 2008, Simon released ‘This Kind Of Love’ exclusively to Starbucks through Hear Music. The album sold 120,000 units.Simon’s claims Starbucks did not honour the marketing commitment they had for the album and argued that the album failed to sell because just five days before the album was released Starbucks started to close down stores.
Los Angeles judge George Wu ruled that Starbucks were under no obligation to share their business decisions with the singer and therefore did not violate any duties to the singer.
He also cited that Starbucks did not take any money or property from the singer so the issue was “a problem of proof and not a problem of pleading”.
Simon has until Wednesday to appeal the decision but would have to prove Starbucks were deceitful to take them matter further.
It seems the only way Simon will be able to get even with Starbucks is to start buying her coffee from Peet’s.
