Don Henley has won a legal battle against a politician who used two of his songs in an election campaign.
Chuck DeVore, a Californian assemblyman, used unauthorised versions of 'Boys of Summer', written by Henley and Heartbreaker's Mike Campbell as well as Henley's 'All She Wants To Do Is Dance' and created campaigns around re-written lyrics.DeVore turned the lyrics of 'Boys of Summer' into "after the hope of November is gone" and 'All She Wants To Do Is Dance' became "all she wants to do is tax".
Under US copyright law, parody is a defence in a copyright infringement case but not this time. Henley, Campbell and Judge James Selna found nothing funny of DeVore's infringement.
"Neither song was fair use", the judge ruled.
