Mariah Carey will launch legal action against porn star Mary Carey in an attempt to prevent the adult actress-cum politician from trademarking her stage name.
Mary Carey, who has starred in such films as 'Double Air Bags 11' and 'Boobsville Sorority Girls', as well as television programs 'Totally Busted' and 'Sexy Urban Legends', ran against Californian Governor Arnold Schwarzenegger in 2003. Born Mary Cook, her attempt to trademark her stage name has been met with anger from Mariah Carey, who is concerned fans may confuse the two.Mariah Carey's legal team wrote Mary a letter in October threatening legal action if she proceeded with the trademarking. With the porn star also seeking trademark for audio and visual recordings, attorney Robert Becker wrote, "Confusion between your client and her MARY CAREY trademark and our client and its MARIAH CAREY trademark is therefore likely."
But Mary Carey - undoubtedly relishing the publicity - has hit back, telling Reuters, "I'm ready to battle Mariah over this because I've been Mary Carey for a long time."
She recently told adult entertainment website AVN.com, "It seems humorous that a musician as popular as Mariah feels her millions of fans might purchase a Mary Carey adult DVD instead of a copy of 'The Emancipation of MiMi' because they are confused by the name. Does she really think her fans are that inattentive?".
Mary Carey's lawyer, David Beichtman, seemed equally bemused by the pop singer's concerns, saying, "My first thought was, does Mariah Carey realize what her lawyer is comparing her to and are they seriously concerned? Do they seriously think the fans are going to be confused?"
